Rentals run on rules

The rent side, in three lines

  • Bestellerprinzip: whoever hires the agent pays. No tenant commission on residential lets.
  • Deposits cap at three months’ cold rent (§551 BGB) and must sit on a separate savings account.
  • Mietpreisbremse caps new leases above local comparative rent in tight areas; Berlin’s Mietspiegel sets the benchmark.
  • Modernization may be passed on at 8% of cost per year (§559 BGB) — check the Anpassung history before you underwrite.

FAQ

Can a non-resident buy an apartment in Germany?

Yes. There is no nationality ban on buying residential property. You will need a notary, a German bank account for settlement, and a budget for transfer tax, notary and registration — typically 8–12% on top of the price in Berlin.

Is sivrce.de a separate website?

No. sivrce.de permanently redirects to sivrce.com/de so Germany has one canonical URL. Georgia stays on sivrce.ge.

How much extra does a purchase cost on top of the price?

Grunderwerbsteuer is state law: 3.5% in Bavaria, 5.5% in Bremen (since July 2025) and Hamburg, 6% in Berlin, 6.5% in NRW, Brandenburg, Saarland and Schleswig-Holstein. Add about 1.5% notary, 0.5% land register, and 3.57% buyer Makler unless the listing is provisionsfrei. Typical cash on top: 8–12%.

Do tenants pay the estate-agent commission?

No. Bestellerprinzip: whoever hires the agent pays. Tenant commission on residential lets is banned. On sales, §656c BGB splits the fee 50/50 unless the seller lists provisionsfrei.

Is an Energieausweis mandatory in the advert?

Yes. The GEG requires the energy certificate (class A+ to H, consumption or demand, and the essential heating facts) in every public advert. sivrce will not publish a German listing that omits those Pflichtangaben.

How do I decide between renting and buying?

Open the Germany rent-vs-buy calculator. It models Kaufnebenkosten per Bundesland, mortgage, rent inflation and the opportunity cost of the down payment. Short stays usually favour renting because closing costs must be earned back first.
